§1 General Provisions

  1. These Terms and Conditions have been prepared by Destrier Legal sp. z o.o., with its registered office in Warsaw at ul. Wł. Pytlasińskiego 10/12, unit 14, 00‑777 Warsaw, entered into the Register of Entrepreneurs under KRS number 0000913262, NIP 521‑39‑35‑148, REGON 389562469 (“the Firm”), on the basis of generally applicable laws, in particular the Act of 18 July 2002 on the Provision of Electronic Services (Journal of Laws 2020, item 344) (“Electronic Services Act”), the Act of 16 July 2004 – Telecommunications Law (Journal of Laws 2019, item 2460), the Act of 4 February 1994 on Copyright and Related Rights (Journal of Laws 2006 No. 90, item 631, as amended) (“Copyright Act”), as well as the provisions of the Civil Code (“Terms and Conditions”).
  2. These Terms and Conditions apply to and govern the use of the Firm’s website available at www.destrier.pl and its related thematic subpages prepared by the Firm (the “Website”). The Terms and Conditions define the rules for using the Website, the rules for subscribing to and receiving periodic electronic communications (“Newsletter”), the conditions for accessing e‑learning content via live online transmission (“Webinar”), the rules governing the Website’s use of cookies, and the rules for submitting CVs through the Website.
  3. All materials and information published on the Website or provided through the Newsletter or Webinar are for informational purposes only. In particular, they should not be treated as comprehensive or formal legal advice in any specific matter or in any individual case concerning the rights or obligations of the Website user.
  4. All materials, statements, and information contained on the Website or provided through the Newsletter or Webinar do not constitute and shall not constitute an offer within the meaning of the Civil Code.
  5. The Firm shall not be liable for any statements or information contained on the Website or provided through the Newsletter or Webinar. In particular, the Firm shall not be liable for any actions taken by the Website user regarding their rights or obligations based on statements or information contained on the Website.
  6. If a Website user wishes to obtain legal assistance or a legal opinion regarding matters related to their rights or obligations, the user should contact the Firm using the contact details provided on the Website or seek individual legal advice from another legal services provider.
  7. The primary method of contacting the Firm through the Website is by submitting an inquiry via the contact form available on the Website.

§2 Rules for Using the Website

  1. The Website constitutes a work within the meaning of the Copyright Act.
  2. The Website user is obliged to use the Website in accordance with applicable law, these Terms and Conditions, and good practice. In particular, the Terms and Conditions prohibit: (i) using any materials or information contained on the Website in a manner inconsistent with their purpose or with applicable law; (ii) using materials or information from the Website to disseminate false, unlawful, or unethical information about the Firm; (iii) using materials or information from the Website for intentional actions aimed at misleading third parties, regardless of the purpose or scope of such actions; (iv) infringing the personal rights of the Firm or its employees; (v) using personal data of the Firm’s team in a manner contrary to applicable data protection laws; (vi) interfering with the Website’s source code or graphic layout.
  3. The Firm provides services using an ICT system enabling the processing, storage, sending, and receiving of data via telecommunications networks, in accordance with the Electronic Services Act.
  4. The content of the Website is legally protected.
  5. Users should read these Terms and Conditions before using the Website. Use of the Website constitutes acceptance of the Terms and Conditions and an obligation to comply with them.
  6. To use the Website, users must have a device with Internet access and a web browser.
  7. Use of the Website is free of charge, voluntary, and available to all Internet users.
  8. Due to possible failures that may hinder or prevent the use of the Website, access may be temporarily suspended until the malfunction is resolved. Temporary suspension may also occur due to maintenance work. In such cases, the Firm will take steps to restore access as soon as possible.
  9. The Firm shall not be liable for improper functioning of the Website resulting from the circumstances described above or from objective reasons beyond the Firm’s control.

§3 Complaints

  1. A Website user is entitled to submit complaints to the Firm regarding malfunctioning of the Website, including issues related to CV submission or temporary unavailability, via email to office@destrier.pl.
  2. Complaints should refer to documented cases of malfunction or unavailability, include a detailed description of the issue, and provide the user’s email address. The Firm may request additional explanations necessary to respond.
  3. The Firm will respond to the user within one month of receiving the complaint, providing explanations regarding the causes of malfunction or temporary suspension.

§4 Newsletter

  1. Under the Newsletter service, the Firm undertakes to periodically send information via email to the address provided by the Website user in the subscription form.
  2. Subscription to the Newsletter occurs by entering an email address in the subscription form and clicking the “subscribe” button.
  3. The email address provided by the user will be used solely for the purpose of delivering the Newsletter.
  4. The Firm will periodically provide Newsletter subscribers with information regarding significant legal or business developments identified by the Firm that may affect Website users.
  5. The user may change the email address used for the Newsletter or unsubscribe at any time by sending a request to the Firm’s email address.

§5 Webinar

  1. The Firm provides a free e‑learning service (“Webinar”) to Website users who express interest in participating in an online seminar at a date specified by the Firm.
  2. The Webinar enables users to participate in online lectures on topics selected by the Firm. The Firm will send a link to the Webinar via email at least one day before the transmission begins.
  3. To properly access the Webinar, the user must have a device meeting the technical requirements, including an Internet connection of at least 3 Mb/s and equipment capable of receiving audio and video.
  4. Materials provided to the user as part of the Webinar constitute a work within the meaning of the Act of 4 February 1994 on Copyright and Related Rights (Polish Journal of Laws 2022, item 2509, as amended) and are intended for personal use only. The user may not reproduce, distribute, share with third parties, or derive financial benefit from them.

§6 Cookies

  1. The Website uses cookies that enable identification of the user and collection of information about users and their use of the Website.
  2. Cookies used by the Website may be persistent or session cookies. Session cookies are deleted when the browser is closed, while persistent cookies remain stored on the user’s device.
  3. By using the Website, users consent to the placement of cookies on their devices.
  4. Cookies are stored solely to ensure proper functioning of the Website, collect statistical data, analyse usage, and determine user preferences.
  5. The Firm uses Google Analytics, which uses cookies to analyse statistical data such as visit counts and demographic information.
  6. Cookies are also used to unify authentication mechanisms for users redirected to the Firm’s social media profiles and to facilitate access to those profiles.

§7 Submission of CVs

  1. Website users may submit CVs to participate in recruitment processes conducted by the Firm. Recruitment is available through the “Career” section of the Website.
  2. Submission of a CV requires the user’s consent to the processing of personal data contained in the CV.
  3. These Terms and Conditions are made available to users via the Website.

§8 Final Provisions

  1. The Firm may amend these Terms and Conditions at any time without stating a reason.
  2. In the event of amendments, the Firm will publish the updated version on the Website.
  3. The amended Terms and Conditions enter into force upon publication.
  4. These Terms and Conditions are governed by Polish law.
  5. In matters not regulated by these Terms and Conditions, the relevant provisions shall apply, in particular the provisions of the Civil Code (Polish Journal of Laws 2014, item 121, as amended), Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, “GDPR”), as well as other generally applicable laws on the protection of personal data.
  6. All matters concerning the Firm’s obligations regarding personal data of Website users under GDPR and other applicable laws are set out in the Privacy Policy available on the Website under “Privacy Policy”.
  7. If any provision of these Terms and Conditions is declared invalid by a final court judgment, the remaining provisions shall remain in force.
  8. Any disputes arising from these Terms and Conditions shall be resolved by the court having jurisdiction over the Firm’s registered office.
